The Spanish Notary intervenes professionally in a multitude of acts and legal transactions, either because the law exceptionally requires them to be formalized in a public deed, as is the case with the incorporation of companies, or generally because, to the notarial document, the law attributes very important effects, given the necessary impartiality, the legal preparation, and the character that every Notary has as a public official.

Thus, the notarial document is enforceable, provides full proof of the date and fact of its granting, is a guarantee of the identity and full legal capacity of the persons who sign it and that it has been concluded freely and voluntarily; and it is therefore a particularly qualified document and as such is subject to registration in the Mercantile Registry or the Property Registry, as the case may be.
